Jail Inmate Nearly Beat to Death While Guard Ignored Pleas

A 30-year old inmate is suing Allegheny County and a correctional officer over a brutal beating he received at the hands of four other inmates. According to the federal lawsuit, he was beaten unconscious and then sodomized by at least one of the attackers. The unidentified jail guard allegedly stood by and took no action.

The Allegheny County Jail, located Pittsburgh, was the scene of the attack. The inmate, whose name was withheld pursuant to a policy of not naming sexual assault victims, was already serving time in federal prison for voluntary manslaughter, but had been transferred to the county jail in preparation for a court hearing.

The inmate was visiting the cell of another prisoner, when the four assailants entered and locked the cell. The victim asked the guard to unlock the cell, but the guard refused. While the four men brutalized the victim, he was able to activate a “cell alert button” which caused the lights to flash on and off in area, signaling an emergency. Instead of responding to the attack, the guard “simply turned off the cell alert and did nothing.”

A police report made part the lawsuit stated that the victim believed that “possibly the inmates who assaulted him may have thought that he had tobacco on him and may have tried to retrieve it from his rectum/anus.”

In addition to the current lawsuit, the jail is dealing with a criminal investigation of three guards who allegedly beat prisoner last month. The inmate, David Kipp, was being held on drug and assault charges and reportedly suffered a broken nose and perforated eardrum.
